The easiest way around this is to simply make sure the participants sign a
disclaimer. "I agree to be taped. I understand that the evaluation is to be
done on the system, and not on myself as a user." And so forth. For my UI
class, we had a generic disclaimer that we gave to our users. (I did a
videotaped evaluation as an assignment in the course). If I can find it I'll
post it....

This is the web site of my Usability Course that I took in the summer. It
may go down at any moment since the course is done.
There is a link called "Informed Consent form to have signed by user...." It
is under section 3, point 16.
A video camera is best since you can point it at the screen and watch what
the user is doing. It'll also get audio. Make sure you keep your user
talking: "I am moving my mouse to look for the CD Player. I do not see the
CD Player under any of the K Menu items, so I'm going to start looking for
sub items. I don't know where it is so I'll check them one-by-one."
(That, by the way, would be a malfunction if the user is searching each menu
systematically trying to look for an application).
