I'm not sure if this is similar, but anyway:

When I use a single kate instance (dont tick "Allot Kate to use more than one UNIX \
process"), I can open up the same file twice, which gets a little annoying after \
changing one version, moving to the next, and Kate complains about the file being \
modified.

I believe the problem comes in when I open the file originally though the "Selector" \
panel (build in finder), then use the "Find in files" panel with the Directory field \
ending with a slash.

This might be similar problem as to what you are experiencing, as the "Find in Files" \
feature with a Directory such as "/var/www/", would build addresses file files which \
match, in the format of:

    /var/www//index.php

Which does address the same file, but is technically a different address.
