Trademarks have domains that they apply to.  For instance Donald Trump 
is trying to trade mark "You're Fire" but it only applies to 
entertainment and specific aspects of that.  He could not, for instance, 
force companies to pay him when they tell an employee they are fired. 
So if they patent the "LiveCD" Term it would not apply in the software 
realm from my pathetic grasp of trademark law.
