At least the idea of a 3D Desktop is not that new. I once had a 3D Desktop for
Windows, which is even freeware I think, which really worked. I think you
could use a theme i.E. like a Doom dungeon and you could place your icons
anywhere in the room. Then you could move through the desktop like with a
Shooter. Therfore I'm pretty sure that, at least a 3D Desktop is not
patentable unless that patent is rather old.

Well. I will keep your post and show it aorund in discussions around here,
because there are still people who think softwarepatents a good idea. Your
mail alone already shows that this is not the case and only blocks
development.
