ROOT.war does not correctly unpack if contains context.xml with a path="" attribute

Yes, all other wars unpack and deploy correctly. Only the case I mention fails.
My host configurations alway have:

unpackWARs="true" autoDeploy="true" xmlValidation="false" xmlNamespaceAware="false"
