It also fails on files that are not copied:

$ svnadmin create repo
$ svn mkdir -mm file://`pwd`/repo/foo
$ svn import -mm Makefile file://`pwd`/repo/foo/bar
$ svnmucc -U file://`pwd`/repo/foo cp head bar bar2 propset p v bar2
r3 committed
$ svnmucc -U file://`pwd`/repo/foo -mm propset p v bar
svnmucc: File already exists: filesystem '/home/pm/sw/subversion/obj/repo/db',
transaction '3-3', path '/foo/bar'
