I have 2.5.45 kernel and same error happens. I think (
not sure ) but error was existent since 2.5.40. So its
better idea to check like 

#if LINUX_VERSION_CODE >= KERNEL_VERSION(2,5,40)
#define modify_ldt_ldt_s user_desc
#endif
