It's possible this might apply in the case of US government agencies
doing classified work (although this might still be a bit of a stretch).
For example, for Navy use you might do a custom Mozilla version with
some modifications that involve the addition of code using classified
algorithms.  You might decide to release the modifications for general
use outside DoD, except for the classified code.  Per section 4 you'd
have to include a LEGAL file stating the reasons why you didn't include
the missing modifications, but you wouldn't be able to describe in
detail the exact nature of the omitted modifications or why they
couldn't be released.
