I'm even less a lawyer than most other people, but I think downloading non-
free stuff is not a problem, if the license of that non-free stuff you 
download doesn't forbid that. The issue this is about that you distribute kate 
in a tarball and call it GPL (or something), which violates the license of the 
author of the file you include, since it's not compatible with that.
