In Kate 2.5.5, KDE 3.5.5 you still have this bug.

Since first example doesn't look nice, here is the explanation:

You have a function, and you comment something out. You put the # sign to the \
beginning of the line (you could comment out lines on different indentation levels). \
This breaks folding. Having the # marks at the real start of the lines will leave \
folding OK, but it is not the thing I usually do, and I think it is not very easy to \
