The outer top of a floating box may not be higher than the outer top of any
block or floated box generated by an element earlier in the source document.
"
and rule 8 of those same rules states

A floating box must be placed as high as possible.

Notes

Firefox 3.5.9, Firefox 3.6.3, IE8, Opera 10.10 and Safari 4.0.5 pass that
testcase.
