I don't think that will be so easy..... Personally I think a MacOS like menubar on top of the screen is a good idea. From a usability point of view it is better then the menubar we have now because of Fitts law and it also wastes less space. I think there shouldn't be any patent issues. The Amiga also used a MacOS like menubar on top of the screen and maybe other UIs like GEM or GEOS for the C64, too, but I don't really remember. But one should probably make absolutely sure that there are no patent issues.
