On the other hand, if you look at something and say, "Uh oh! Apple is
liable to sue!" at a minimum that suggests that it seems more imitative
than innovative.

And most of the fuss has been about the widget theme used in the
screenshots (which is obviously a direct copy of Aqua but has nothing to do
with the style) rather than about the style itself.

As far as the reality of the risk, using Apple logos is begging for legal
trouble. (At the moment, Apple is going after the Church of Satan for such
violations. No, I'm not making this up.) Obviously imitative themes are
safer, but why take the risk in order to look like a copycat? A novel
translucent style, like what Mosfet has done, shouldn't be a problem.
