This is not a bug. The first file you're editing belongs to root, and
therefor the checkboxes are not active. In the second case, the file is
yours and the boxes are active.

The blue color of the cross in the checkbox is a visual indication that the
checkbox in not active. Just like greyed out menu entries, only a little
less obvious :)
