The reason is in the Unicode standard:

"Use of a BOM is neither required nor recommended for UTF-8 [...]" 
(in http://www.unicode.org/versions/Unicode4.0.0/ch02.pdf)

But it is still allowed to use one, for whatever reason one could find to mark 
the endianess of a single-byte sequence ;)
