I guess you're right.  I was particularly thinking that it should silence
the arguments that Dennis makes, since his primary arguments (freedom of
speech, mail servers as "public" property, and nobody is harmed) were the
same arguments presented by the spammer and which were emphatically thrown
out by the judge.  However, Dennis responds:

As if ISP's are not private companies.  Also, concerning the recipients,
the judge ruled that there were damages becasue of the lost productivity of
the employees that were spammed.  Spam costs the recipients plenty.
