The answer to this is probably the same as the answer for any other
xorg code you encounter without an explicit license. I answered this
before in some detail for the I2C code in the server:

The dummy driver has a similar history, we imported it when we forked
from xfree86 and we (intentionally) forked from just before the change
to XFree86 1.1 license. As a project we've assumed unlicensed
contributions are made under MIT-like terms. If you want a stronger
assurance than that, probably that's between you and your lawyers to
work out.
