Has any consideration been given to combining the PECSENC's 
recommendations with the administration's "Cyberspace Electronic 
Security Act" proposals as a way to end the crypto impasse? 
Eliminating most controls on strong cryptography while authorizing 
the government to use surreptitious means to get at keys and 
encrypted data in certain criminal cases under court order seems like 
a reasonable compromise.

Laws work best when they recognize reality. Bad guys will get strong 
crypto, controls or no, and if you don't trust the government, you 
have to assume they will use the surreptitious means anyway.
